Terms of Service

Welcome to CataThrift! These Terms of Service ("Terms") govern your access to and use of the CataThrift platform, operated by MMOD, Inc. ("CataThrift," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, making a purchase, or otherwise using CataThrift, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years of age to use CataThrift. By using our services, you represent and warrant that you meet this age requirement.

3. Account Registration

To access certain features, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Platform Description

CataThrift is a marketplace and point-of-sale platform that connects thrift stores with consumers. We provide tools for inventory management, product listing, payment processing, and order fulfillment. CataThrift does not own or hold inventory; products are owned and shipped by individual thrift stores.

5. Pricing and Fees

For thrift stores, CataThrift offers two billing plans:

• Percentage Plan: 5% platform fee on in-store POS transactions, 15% on online orders
• Subscription Plan: $99/month with 0% platform fee on POS transactions, 15% on online orders

All transactions are subject to payment processing fees of 2.9% + $0.30. Shipping and delivery fees are additional and vary by carrier and method.

6. Orders and Payments

When you place an order, you agree to pay the listed price plus applicable taxes, shipping, and fees. Payments are processed securely via Stripe. By saving a payment method to ThriftPay, you authorize CataThrift to charge that method for future purchases.

7. Shipping and Delivery

Shipping methods, costs, and delivery timelines vary by store and product. CataThrift facilitates shipping label generation and local delivery options but is not responsible for carrier delays or lost packages. See our Shipping Policy for details.

8. Returns and Refunds

Return and refund policies are set by individual thrift stores. CataThrift facilitates the refund process but each store determines its own return window and conditions. See our Refund Policy for details.

9. Prohibited Conduct

You agree not to:

• Use the platform for any unlawful purpose
• List counterfeit, stolen, or prohibited items
• Interfere with or disrupt the platform's operation
• Attempt to gain unauthorized access to other accounts
• Engage in fraudulent transactions or chargebacks

10. Intellectual Property

CataThrift and its original content, features, and functionality are owned by MMOD, Inc. and are protected by international copyright, trademark, and other intellectual property laws.

11. Disclaimer of Warranties

CataThrift is provided "as is" and "as available" without warranties of any kind. We do not guarantee the accuracy of product listings, availability of items, or condition of products sold by third-party stores.

12. Limitation of Liability

To the maximum extent permitted by law, MMOD, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of CataThrift.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of CataThrift after changes constitutes acceptance.
